What Changed

FMCSA granted Aurora Operations a limited five‑year exemption from the warning‑device placement, steady‑burning lamp, and device‑type requirements that normally apply to stopped commercial motor vehicles. The exemption permits the use of cab‑mounted warning beacons on Level 4 automated driving system (ADS) vehicles. The decision was published in the Federal Register on October 9, 2026, and became effective on October 7, 2026, expiring on October 7, 2031.

Who Is Affected

The exemption applies to Aurora Operations (USDOT #341156) and to any other motor carrier that operates Level 4 ADS‑equipped commercial motor vehicles and has provided prior notice to FMCSA. Carriers that do not operate Level 4 ADS vehicles or have not notified FMCSA are not covered by this exemption.

What Carriers Should Check

Carriers must confirm that their Level 4 ADS fleets have received the exemption notice and that they are using cab‑mounted warning beacons in place of the traditional devices. They should verify that the beacons meet the safety standards outlined in the exemption and that no other warning‑device requirements remain in force. Carriers should also keep records of the exemption notice and any related correspondence with FMCSA.

What Remains Unclear

Interpretation: FMCSA stated that granting the exemption would likely achieve a level of safety equivalent to or greater than the regulation. However, carriers should monitor future guidance to understand how FMCSA will enforce or review the safety equivalence over the five‑year period. The impact on interstate operations and any state‑level requirements is not detailed in the notice.
