FMCSA Announces Pilot on Split Sleeper Berth Time

The Federal Motor Carrier Safety Administration has issued a notice inviting comment on a proposed study that would let commercial drivers split their sleeper berth time. The study aims to see if more flexible rest options improve driver well‑being and keep safety on par with current rules.

Who Is Affected?

The pilot targets commercial motor vehicle drivers and the carriers that employ them. The data will come from about 256 drivers, so carriers with drivers who might qualify for the exemption should pay attention.

What Carriers Should Do

  • Review the FMCSA notice and the docket number FMCSA-2026-2080.
  • Determine if any of your drivers could participate in the pilot.
  • Confirm how the proposed split‑berth rule would apply to your operations.
  • Submit comments by December 7, 2026, if you have concerns or support.

Uncertain Outcomes

FMCSA has not yet approved the study. The results will only be available after data collection and analysis, so carriers should not assume any regulatory change until FMCSA publishes findings.
