Renewal and New Applications for Hearing Exemptions in CMV Driver Qualification
What Changed?
FMCSA has renewed hearing exemptions for 38 drivers and announced new applications from 20 individuals. The renewals cover exemptions that allow hard‑of‑hearing and deaf drivers to continue operating interstate CMVs.
The notices list 20 renewed exemptions (from docket FMCSA‑2012‑0332, FMCSA‑2013‑0123, FMCSA‑2014‑0107, FMCSA‑2014‑0384) and 18 renewed exemptions (from docket FMCSA‑2013‑0122, FMCSA‑2014‑0385, FMCSA‑2015‑0329, FMCSA‑2017‑0059). Additionally, FMCSA received 9 applications (FMCSA‑2026‑0054) and 11 applications (FMCSA‑2026‑0053) for new hearing exemptions.
Who Is Affected?
The exemptions apply to individual CMV drivers who are hard of hearing or deaf and who meet the criteria set in the FMCSRs. Carriers that employ these drivers must ensure the exemptions are current and documented.
The renewed exemptions remain in effect until the expiration dates listed in each notice. Carriers should check the specific docket numbers and expiration dates to confirm that the drivers’ exemptions are still valid. The new applications are pending; carriers should monitor the docket FMCSA‑2026‑0054 and FMCSA‑2026‑0053 for decisions.
What Carriers Should Do
Review exemption records for all hard‑of‑hearing drivers. Verify that each exemption is active and that the driver’s medical documentation is up to date. Submit comments by October 28, 2026, if carriers have concerns about the renewal or application process.
Carriers should also confirm that their driver qualification files include the exemption status and that any required training or safety measures are in place. If a driver’s exemption expires, the carrier must determine whether the driver can continue or needs to seek a new exemption.
